He resigned as music director, I did not sign anything, I can be sued for breach of contract?
We have been working with an illegal script (photocopies reading the copy). I have not even had the score only a photocopy of the vocal score. When I agreed to do the program in September, I promised three payments of 500.00 in September of one (I received) a midway, which was in February (I have not seen and is now April) and final payment after the show was director complete. The is threatening to sue me for breach of contract. You can do that or I can ride this?
Was there a written contract or verbal? Verbal would be valid in a job at will state. If there is no contract, no offense. If there was a contract, it fails? Does the contract state that you must do to claim a violation? Did you or she do that? Finally, finding a strong public good (not violate the rights of a copyright), has been considered a valid reason for the breach of contract. In short, yes, she can sue, but it is unlikely that she will win.
